Terms and Conditions

1. SCOPE

1.1 The terms and conditions listed here apply to the services, products, and sales of the company Carapaz SA, based in St-Blaise, Switzerland.

1.2 Carapaz SA reserves the right to change the terms at any time. The changes will take effect once they are published on this website under « Terms & Conditions ». For already made purchases the version applies which was published at the time of purchase.


2. OFFERS, PRICES AND PURCHASING AGREEMENT

2.1 Our offers are not binding in terms of price, quantity, performance, delivery time, and delivery options. Reserved are also changes in the design, operation, colors, as well as errors in descriptions, pictures, and price information.

2.2 A purchase contract is only valid through written confirmation by Carapaz SA, and only once the goods were sent to the customer.

2.3 An automatically generated e-mail confirming an order, does not alone represent a purchase agreement.

2..4 Should an item no longer be available for any reason, then the purchase agreement may be canceled by both sides, and there is no obligation for Carapaz SA to deliver the item.

2.5 Our prices correspond to the product next to which or under which they stand. They can be displayed in CHF or any other another currency available on our website.

2.6 If a price is traced and replaced by another price next to it, then the ονε which is not traced is valid. This is particularly the case with reduced price offers.

2.7 The prices in our internet shop include the Swiss VAT, but not the VAT or sales tax when imported to other countries.


3. PAYMENT

3.1 Payments can be made only through the payment gateways offered by our online store, or via bank transfer. We accept payments through Paypal, Credit Cards (via Stripe), PostFinance, and bank transfer.

3.2 Orders are generally executed only after we receive the payment.

3.3 If a payment has not been made within 10 days after the order, we reserve the right to cancel the order.


4. DELIVERY

4.1 The dispatch of our goods is usually completed within 2 working days from receipt of payment. In exceptional cases, this period may also take longer, but we will in this case try, whenever possible, to inform the customer.

4.2 The customer pays for the shipping costs unless stated otherwise. The delivery options and shipping costs are displayed before the definitive purchase if possible. 

4.3 Shipping is not included in our item prices, unless stated otherwise.

4.4 If the goods are shipped with uninsured by mail, the risk of loss is taken by Carapaz SA, as long as all delivery information has been provided correctly by the customer. If we should suspect abuse or fraud, we reserve the right to take legal action, not to ship a replacement item, or not to pay a refund.

4.5 If the customer provided a wrong address or other wrong delivery information, Carapaz SA won't pay for any additional costs resulting from the wrong information, nor issue any refunds.

4.6 Carapaz SA is not liable for failing to meet delivery deadlines.

4.7 In case of a lost or much delayed shipping, Carapaz S will request an inquiry through the shipping carrier. This is, however, only possible with items sent with tracking number (signature mail).

4.8 For deliveries abroad, the customer is fully responsible for paying import duties, VAT, or handling fees which can be asked by the authorities of his country or the mail delivery service. 


5. CANCELLATION AND REFUND

5.1 An order can be canceled only if the goods have not yet been shipped by Carapaz SA. Has the money already been paid by the customer, but the merchandise not shipped yet, a full refund is normally possible.

5.2 Should a customer wish to cancel an order even after shipping, he can refuse delivery at the door and return the package unopened. If the package has been opened, he needs to ship the merchandise back at his own expense. A full refund is only provided if the goods are returned in perfect condition. 

5.3 Shipping costs are not refunded.


6. RETURN POLICY

6.1 We accept returns of our goods up to 14 days after reception.

6.2 In order to make use of the return right, the buyer is asked to contact us (by telephone or email) within 14 days after reception of the item and specify the reason for the return.

6.3 The buyer must not return an item without having received the explicit permission from Carapaz SA to do so.

6.4 The buyer has to pay for the cost of returning the merchandise to Carapaz SA. These shipping costs are not refunded, and the buyer is responsible for the item until it arrives at Carapaz SA.

6.5 The original shipping cost will not be refunded, only the actual item price.

6.6 In order to receive a full refund of the item's sales price without further deductions, the goods must arrive at Carapaz SA in perfect resale condition and shouldn't show any signs of wear whatsoever. If this isn't the case, we reserve the right to make a partial refund, or no refund at all, depending on the condition of the item.


7. EXCHANGE

7.1 Our goods can be exchanged, but the same principles apply as for the right of return:
- The customer must inform us within 14 days after reception, by phone or e-mail and provide a reason.
- The customer bears the cost for the return shipping to Carapaz SA.
- If we made a mistake with the order, the new shipping cost will be payed by Carapaz SA, and the return expenses paid by the customer will be refunded.
- The goods must arrive in perfect resale condition at our company and must not show any signs of wear.
- Should the goods show signs of evident use, Carapaz SA will exchange them only for an additional cost, or the items can be sent back to the customer.


8. WARRANTY

8.1 We provide a warranty of 1 year on all products except for electronic cases, where the warranty is 3 months. The products to which our 1-year warranty applies are shipped with a warranty card. This warranty covers manufacturing and material defects that occur within a year after purchase. Should such an error occur on one of our products, we will repair it or, if in stock, replace the item. Should neither of the two be possible, the customer will receive a coupon for the amount of the purchase, or receive a refund.

8.1 Excluded from the warranty are all damages which are not due to manufacturing or material defects. This applies for wear of any kind, as well as for defects due to exposure to moisture, perspiration, chemicals, heat, and any type of physical influence. Also excluded from the warranty are not functionally relevant, cosmetic defects, such as scratches, scars, marks, imprints, irregularities in the leather, etc.


9. LIABILITY

9.1 Carapaz SA shall not be liable for direct or indirect damage caused to objects or persons that result from the use of Carapaz products.

9.2 Carapaz SA is not liable for any costs resulting from delivery delays, lost shipments, or other similar circumstances.


10. INTELLECTUAL PROPERTY AND COPYRIGHT

10.1 The name "Carapaz" is protected by trademark law, and any use without the explicit permission of Carapaz SA is prohibited.

10.2 The copyright and distribution rights of all goods sold under the brand name Carapaz belong to the company Carapaz SA, and may not be copied, imitated or reproduced in any form, without the written permission of Carapaz SA.

10.3 Carapaz SA reserves the rights to sell goods which are sold under the brand name Carapaz also to corporate customers, featuring their own company logo.

11. PRIVACY

11.1 Carapaz SA will not transmit customer data for commercial use to third parties. However, they might be stored on third-party servers for use of their services.

11.2 Carapaz SA reserves the right tu use customer data, and in particular e-mail addresses, for their own advertising, unless this is not desired by the customer.

11.3 Our Internet shop is hosted by Shopify Inc. By using our website the customer should be aware that the customer's data will be stored by Shopify International Ltd. in Ireland, Canada, and the U.S.A.

12. LAW AND JURISDICTION

12.1 The Swiss law applies for all business transactions.

12.2 Jurisdiction place is Neuchatel, Switzerland.
